Aircraft Repainting and Cirrus Paint Scheme Policy

Scope and Purpose

This Policy governs:

(a) the ownership, use, reproduction, modification, and derivative use of Cirrus proprietary paint schemes, designs, and color combinations (collectively, “Cirrus Paint Schemes”);

(b) the conditions under which Cirrus Paint Schemes may be applied to Cirrus aircraft, including who may apply them; and

(c) general repainting requirements for Cirrus aircraft, including the distinction between Cirrus Paint Schemes and non-Cirrus paint schemes.

Aircraft owners remain free to apply non-Cirrus paint schemes of their choosing, subject to FAA regulations and AMM requirements.

Technical Compliance and Airworthiness

All repaint work on Cirrus aircraft must comply with the Aircraft Maintenance Manual (“AMM”), including AMM Chapter 4, and all applicable FAA regulations. Failure to adhere to the AMM and FAA requirements may result in an unairworthy condition and may void applicable warranties.

Cirrus Proprietary Rights

Cirrus Paint Schemes are valuable proprietary assets and are protected by U.S. copyright, trade dress, trademark, and other intellectual property laws. Cirrus is the exclusive owner of Cirrus Paint Schemes.

No person or entity may reproduce, modify, or use Cirrus Paint Schemes, or create derivatives of them, except as expressly permitted by this Policy or by a written agreement signed by Cirrus. Nothing in this Policy transfers ownership of any intellectual property or creates any implied license beyond the limited permissions expressly stated.

Limited Permission to Apply Cirrus Paint Schemes (ASCs Only)

Cirrus Authorized Service Centers (“ASCs”) with a current, valid Cirrus Authorized Service Center Agreement are granted a limited, revocable, non-transferable, non-sublicensable permission to apply Cirrus Paint Schemes solely as described in this Section

No other paint shop or third party is authorized to apply, reproduce, modify, or create derivatives of Cirrus Paint Schemes.

ASCs may apply or otherwise use Cirrus Paint Schemes only under the following conditions:

  1. Cirrus-Approved Custom Designs. ASCs may apply a custom Cirrus design obtained through Cirrus or a Cirrus-approved design house, provided that prior written approval is obtained from Cirrus before commencing the work.
  2. Base Schemes. ASCs may repaint an aircraft using Cirrus base Paint Schemes (e.g., Carbon or Platinum) from the aircraft’s current generation or one generation prior (e.g., a G6 aircraft may receive a G6 or G5 base scheme). 
  3. Xi™ designs, Special Edition schemes.  ASC’s may repaint Xi™ designs, Special Edition schemes, and proprietary current-generation colors only if the aircraft was originally delivered with that scheme or color or Cirrus provides prior written approval. 
  4. Faithful Reproduction Requirement. When applying an authorized Cirrus Paint Scheme, ASCs must reproduce the approved scheme faithfully and accurately, except to the limited extent expressly permitted by this Policy or approved in writing by Cirrus.
  5. No “Close Copy” Workarounds. ASCs may not apply any paint scheme that is substantially similar to a Cirrus Paint Scheme, including by minor modifications to colors, stripe widths, gradients, placements, or accent elements, where the overall commercial impression is derived from a Cirrus Paint Scheme.
  6. No Transfer of Cirrus Paint Materials. ASCs may not sell, transfer, or provide Cirrus paint materials (including paint codes, mixing formulas, masking patterns, templates, or design files) to non-ASCs, except for small-quantity touch-up paint sold to aircraft owners for minor repairs.

Email confirmation from upgrades@cirrusaircraft.com or another Cirrus-designated email address shall constitute written approval for purposes of this Policy.

Cirrus reserves the right to modify, suspend, limit, or revoke the permissions granted under this Policy at any time in its sole discretion.

Non-Cirrus Paint Schemes

Aircraft owners may repaint their Cirrus aircraft using paint schemes that are not based on, derived from, or substantially similar to any Cirrus Paint Scheme.

Cirrus does not regulate or approve non-Cirrus paint schemes, provided that:

  1. All repaint work complies with FAA regulations and AMM Chapter 4;
  2. The paint scheme does not copy or derive from any Cirrus Paint Scheme or otherwise create a substantially similar overall appearance; and
  3. Cirrus trademarks, logos, model designations, or other Cirrus branding are not used without Cirrus’s written consent.

Non-Cirrus paint schemes may be applied by any paint shop, whether or not it is an Authorized Service Center, subject to the foregoing requirements.

Enforcement

This Policy is subject to and in addition to all applicable intellectual property laws.  All remedies set forth herein are cumulative and not exclusive.

Cirrus’s failure to object to any repaint work does not constitute approval, waiver, or authorization. 

If an ASC violates this Policy, Cirrus may require corrective action, suspend or terminate the ASC Agreement, revoke authorization to use Cirrus Paint Schemes, and pursue any other available remedies.

Any unauthorized reproduction, modification, or derivative use of Cirrus Paint Schemes by any party may result in legal action for intellectual property infringement, including injunctive relief, monetary damages, and recovery of attorney’s fees where available.

Cirrus may amend this Policy at any time by posting updates on the Cirrus website or providing notice to ASCs.
